What Is A Sexual Assault Charge In New Jersey?

The state of New Jersey defines sexual assault as a crime in which a person commits “an act of sexual penetration” on another under various, nonconsensual scenarios. These include:

  • There was a lack of consent, but without serious injury.
  • The victim is between 16 and 18.
  • The victim is related to the accused.
  • There is a supervisory relationship between them.

There are several other conditions here, but a sexual assault crime is a felony of the second degree.

What Are Aggravated Sexual Assault Charges?

An aggravated sexual assault is similar to sexual assault, in that the act is the same, however, the circumstances included are more serious. They include:

  • The victim is physically or mentally incapacitated.
  • The victim is injured by the act.
  • There is more than one perpetrator in the act.
  • The act accompanies another crime.
  • The perpetrator is armed.
  • The victim is less than 13 years old.

The state charges people accused of aggravated sexual assault with a first-degree crime. This crime can carry a sentence of 25 years to life in prison.
