If you qualify under New Jersey law to seek damages for the wrongful death of another person, you may wonder exactly what types of losses you can recover. Under New Jersey law, damages in a wrongful death lawsuit are intended to compensate family members for any losses caused by the accidental death. They include:

  • Any loss of income, wages or other payments that would have provide financial support to family members. Typically, the full amount of damages is based on an expectation that the deceased would have worked until retirement.
  • Any unreimbursed medical expenses incurred by the deceased as a result of the accident, but before death
  • The loss of companionship or consortium, or of the comfort, care or guidance that would be provided by a family member
  • Any lost household services, such as childcare, cleaning and preparation of meals, that would have been provided by the deceased
  • Reasonable funeral and burial expenses

There is no right, under New Jersey law, to pursue either punitive damages or losses tied to emotional distress in a wrongful death suit. You may, however, file a separate claim for infliction of emotional distress if you were present and witnessed the death of your loved one.
