Why does workers’ compensation get denied?

You get injured and file for workers’ compensation. You feel like you should get it. You clearly cannot work while you recover, and you have serious medical bills to consider.

However, your claim gets denied. The first step to take is to figure out why it happened. Here are some of the most common reasons:

You can’t provide enough evidence of a work-related injury. This is why it’s important to see a medical professional to get things on record.

You did not go see a doctor at all. They can deny your claim simply for neglecting proper care when the injury happened.

It’s not an injury type that is eligible for compensation.

You took some action that disqualified yourself for compensation. Maybe you were drinking on the job, for instance, or you got injured while engaging in horseplay that falls outside of your work duties.

You actually got hurt at home or outside of work. You only claimed it was a workplace injury after the fact.

You took too long to report your injury. The best thing you can do after a workplace injury is to seek medical help and report it to your supervisor immediately. That way, there is no question of when you actually got hurt.

Now, just because your employer cites one of these reasons for the denial does not mean it has to stand. Maybe they claim you got hurt at home, but you know full well that it happened at work. It is important to understand all of the legal steps you can take moving forward.
