39-year-old Billy Lawa is in good condition after a workplace accident on September 4 ended up with Mr. Lawa being airlifted to Robert Wood Johnson University Hospital in New Brunswick. According to police statements, Mr. Lawa was backing up the forklift when he struck a metal crossbar. He ended up pinned under the metal crossbar, with pallets on top of him.

This unfortunate accident offers an opportunity to illustrate the different types of compensation that might be available to a worker after a serious accident like this one. Of course, the accident victim can-and should-file a workers' compensation claim. The New Jersey workers' compensation system provides financial compensation to workers after on-the-job injuries; in return for having access to compensation, workers are prohibited from suing their employers for additional financial help after an injury.

However, the workers' compensation laws do not prohibit an injured worker from taking legal action against other companies or individuals who may have caused the accident, in whole or in part. This right to sue a third party is especially important in catastrophic injury cases, where the workers' compensation amounts may not fully support the injured worker and his or her family.

When an experienced workplace injuries attorney investigates an accident like the Middlesex forklift accident, questions to be asked include:

  • Did the forklift experience mechanical failure due to a faulty part or a faulty design?
  • Was the operator properly trained in forklift operation? If not, does the employer contract with a third-party company to conduct training?
  • Did another person, not an employee, do something to cause the accident?

By finding the answers to these and other important post-accident questions, the attorney can ensure that the accident victim gets full and fair compensation for his or her injuries, from all available sources.
