Family Members in Delaware Indicted for Cyberstalking
A family tragedy is playing out in the public eye currently, and it offers a clear example of how family conflicts can get out of hand and result in criminal charges. On August 6, 2013, a federal grand jury indicted a woman and her two adult children for the crime of interstate cyberstalking leading to the death of the victim. In February 2013, the woman’s husband shot and killed his ex-wife and the ex-wife’s friend inside a county courthouse, where the women were waiting to attend a child support hearing.
The indictment charges the woman and her adult children with participating in “a multi-pronged campaign designed to surveil and disseminate false and defamatory information” about the ex-wife and placed her “under surveillance with intent to kill and injure and harass and intimidate.”
The specific incidents of cyberstalking alleged in the indictment include:
- Using social media websites and video hosting websites to falsely claim that the shooting victim was guilty of child abuse and neglect, suffered from mental illness, and had committed crimes
- Hacking the victim’s personal Facebook page and transmitting information from it to the victim’s Facebook connections, including false claims of child abuse
The criminal case against the family members who are charged with participating in the cyberstalking campaign was brought in federal court. Internet crimes like cyberstalking are commonly charged in federal criminal court instead of the state courts because the crimes often occur across state lines, via the Internet.
