Lost Wages

Compensation for lost wages will typically be based on two different factors: whether your disability is total or partial, and whether or not the injury is temporary or permanent. Most workers’ compensation claims involve injuries that have resulted in a temporary total disability, where the injured party cannot perform any job-related duties for a limited period of time. To qualify for permanent disability benefits, you need not show that you cannot work at all, but only that you are unable to return to your job or a similar one. If your disability is considered to be total, you will receive the maximum benefit, using calculations based on prior income, for a specified period. If your disability is determined to be partial, the workers’ compensation provider will pay a percentage of benefits available, calculated on the degree of disability.

The Costs of Medical Care

After a workplace injury, you are generally entitled to reimbursement or payment of all medical expenses resulting from your accident or injury, including hospital expenses. Coverage typically includes doctor visits, prescriptions and any necessary surgical procedures.
