Multiple Factors Can Cause a Semi – Car Collision, Which May Mean Several Parties Are Liable

The fatal accident happened on I-78 in Bethlehem Township in the early morning hours of Saturday, August 31. A semi truck had crashed, and a second semi truck driver stopped his rig to help the driver of the first truck. A car, holding a driver and three passengers, collided with the second tractor trailer. A 32-year-old Virginia man was killed, and the other three occupants of the car were critically injured.

The surviving family members of the man who was tragically killed in this truck accident may be able to file a wrongful death claim and achieve some sort of financial compensation, although money will never replace a lost husband, father, or son. The other car occupants will attempt to recover financial compensation for their own injuries, for lost wages due to time off work, and perhaps lost future earnings and other financial needs depending on how much their injuries change their lives.

When investigating an accident like this one, a conscientious plaintiff’s personal injury lawyer uses all the tools at his or her disposal to seek out all possible people and companies that may have been wholly or partly responsible for causing the accident. We do not know what happened in this tragic case, but some of the questions a personal injury attorney should ask are:

  • Did the driver of the rig that crashed follow all proper safety protocols to minimize the hazard his rig presented to other drivers, if he was uninjured and able to do so?
  • Did the driver of the second rig act negligently in failing to place hazard cones, use hazard lights or otherwise warn motorists of the presence of two large tractor trailers on the roadside?
  • Was there a foreign substance on the road, spilled in an earlier accident, that contributed to the accident? Who caused the spill and who was responsible for cleaning it up?
  • Did the first tractor trailer have a defective part that caused it to crash? Who manufactured that part?
  • Did the big rig crash due to negligence of its driver?
  • Was the driver of the passenger vehicle operating under the influence, texting while driving, or disregarding traffic safety in another way?

The list of questions goes on, but you can see how complicated the legal process can be in multi-person, multi-vehicle accidents that result in death and catastrophic injury.
